TERMS OF SERVICE

1. INTRODUCTION

Welcome to Artists of Beauty. These Terms of Service ("Terms") govern your use of the Artists of Beauty website, mobile application, and services (collectively, the "Services").

Artists of Beauty S.A. ("Artists of Beauty," "we," "us," or "our") is a company registered in Panama. By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Services.

2. ELIGIBILITY

You must be at least 18 years of age to create an account and use our Services. By creating an account and using our Services, you represent and warrant that:

• You are at least 18 years of age
• You can form a binding contract with Artists of Beauty
• You are not prohibited from using the Services under applicable laws

3. ACCOUNT REGISTRATION AND SECURITY

3.1 User Accounts

To access certain features of our Services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to immediately notify Artists of Beauty of any unauthorized use of your account.

4. BOOKING SERVICES

4.1 Booking Process

Our Services allow you to book beauty services including but not limited to hair styling, makeup application, and nail services. All bookings are subject to availability and our acceptance.

4.2 Payment and Deposits

Full payment is required at the time of booking to secure your appointment. We accept payment via credit/debit cards, Yappy, and bank transfers.

4.3 Prices and Service Information

All prices displayed are in Panamanian Balboa (PAB) and are inclusive of taxes unless otherwise stated. We reserve the right to modify prices at any time.

4.4 Service Locations

Our services are primarily provided in Panama. Occasionally, we may provide services at other destinations subject to additional terms and fees.

5. CANCELLATION AND REFUND POLICY

5.1 Cancellation by Client

Our cancellation policy is as follows:

• Cancellations made more than 4 hours before the scheduled appointment: 100% refundable
• Cancellations made between 1-4 hours before the scheduled appointment: 50% refundable
• Cancellations made less than 1 hour before the scheduled appointment: Non-refundable

5.2 Modifications

Appointment rescheduling is subject to availability and must be requested at least 4 hours before the scheduled appointment to avoid cancellation fees.

5.3 No-Shows

If you fail to attend your scheduled appointment without prior notice, this will be considered a "no-show" and no refund will be provided.

5.4 Cancellation by Artists of Beauty

We reserve the right to cancel or reschedule appointments due to unforeseen circumstances, including but not limited to stylist illness, extreme weather, or emergencies. In such cases, we will provide a full refund or reschedule your appointment based on your preference.

6. HEALTH AND SAFETY

6.1 Client Disclosure

You must disclose any allergies, sensitivities, medical conditions, or other health concerns that could potentially be affected by our services before your appointment. Failure to disclose relevant health information may result in service denial without refund.

6.2 Patch Tests

For certain services, particularly those involving hair color, we may recommend a patch test 24-48 hours before your appointment to check for allergic reactions. If you decline a recommended patch test, you assume all risks associated with potential adverse reactions.

6.3 Right to Refuse Service

We reserve the right to refuse service to anyone if we believe providing the service would pose a health or safety risk to the client or our staff.

7. LIMITATION OF LIABILITY

7.1 Service Satisfaction

While we strive to provide high-quality services, we cannot guarantee that you will be satisfied with the results of any service. Our liability is limited to providing a remedy service within 7 days of the original service, subject to our discretion.

7.2 Allergic Reactions and Adverse Effects

We are not liable for allergic reactions or adverse effects resulting from our services where you:

• Failed to disclose relevant health information
• Declined a recommended patch test
• Have a previously unknown sensitivity to products used

7.3 Personal Property

We are not responsible for loss or damage to personal property while using our Services.

7.4 Limitation of Damages

In no event shall Artists of Beauty be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

7.5 Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ARTISTS OF BEAUTY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. USER CONDUCT

You agree not to:

• Use our Services for any illegal purpose
• Interfere with or disrupt our Services
• Harass, abuse, or harm another person
• Impersonate any person or entity
• Engage in any fraudulent activity
• Violate any applicable laws or regulations
• Attempt to circumvent any security features of our Services

9. INTELLECTUAL PROPERTY

9.1 Artists of Beauty Content

All content on our Services, including but not limited to text, graphics, logos, icons, images, and software, is the property of Artists of Beauty or its content suppliers and is protected by international copyright laws.

9.2 Client Photos and Testimonials

By consenting to before/after photos or providing testimonials, you grant Artists of Beauty a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content for promotional and marketing purposes. You may revoke this consent at any time by contacting us in writing, though we cannot recall previously published materials.

9.3 Trademarks

The Artists of Beauty name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Artists of Beauty or its affiliates. You may not use such marks without the prior written permission of Artists of Beauty.

10. PRIVACY POLICY

Your privacy is important to us. Our Privacy Policy , which is incorporated into these Terms by reference, explains how we collect, use, and disclose information about you.

11. MODIFICATIONS TO THE SERVICE AND TERMS

11.1 Modifications to the Service

We reserve the right to modify or discontinue, temporarily or permanently, our Services (or any part thereof) with or without notice.

11.2 Modifications to the Terms

We may modify these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Services after such modifications constitutes your acceptance of the modified Terms.

12. TERMINATION

We may terminate or suspend your account and access to our Services immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

Upon termination, your right to use the Services will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. DISPUTE RESOLUTION

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Panama, without giving effect to any principles of conflicts of law.

13.2 Jurisdiction

Any dispute arising from or relating to these Terms or our Services shall be resolved exclusively in the courts of Panama.

13.3 Time Limitation

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of our Services or these Terms must be filed within one (1) year after such claim or cause of action arose or be forever barred.

14. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Artists of Beauty, its affiliates, and their respective officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

15. FORCE MAJEURE

Artists of Beauty shall not be liable for any failure to perform its obligations under these Terms where such failure results from any cause beyond Artists of Beauty's reasonable control, including, but not limited to, mechanical, electronic, or communications failure or degradation, acts of God, terrorism, pandemic, epidemic, quarantine restrictions, or government restrictions.

16. SEVERABILITY

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

17. ASSIGNMENT

You may not assign or transfer these Terms, by operation of law or otherwise, without Artists of Beauty's prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. Artists of Beauty may freely assign or transfer these Terms without restriction.

18. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any other legal notices published by Artists of Beauty on the Services, constitute the entire agreement between you and Artists of Beauty regarding our Services and supersede all prior agreements and understandings.

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Artists of Beauty's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
